Tilting the Scales of Super Hero Justice

This new and exciting blog examines the law from the perspective of an attorney who treats both Super Heroes and the so-called Super Villains as equals under the law. Although certain Super Villains are so labeled by the machine known as "the media", things in the Marvel Universe are often not so black and white, but are many shades of gray.

I was once labeled a Super Villain. Who knows who makes this stuff up, but I certainly am no Super Villain. Maybe a Mini-Villain, or a Part-Time Villain or just a SOB attorney. Growing up, my grandparents were Super Villains, my parents were Super Villains, and somehow I was just expected to be another Super Villain. I never felt particularly villainous and I still don't. Anyway, I am here to break tradition and tell the story from the perspective of an attorney who believes not all Super Villains are created equally bad. I am going to explore the world of the law based on a system of justice that is supposed to assume innocence above all else.

If you have spotted something amiss in the Marvel Legal Archives (MLA or as otherwise known to some of you as the comic books) then post your legal questions, concerns, disputes, etc. to this blog. I will be happy to argue the merits of your case, even if I agree with you. Can you tilt the scales of justice in your favor?

The Venom subject...
Now, is there any way possible the Eddie Brock could sue Macdonald Gargan for becoming Venom? I believe that he should, for Eddie IS Venom, without Eddie there IS NO Venom. I do like gargan, though, but Eddie IS Venom. What can be done abouth this.

Legal Question.
Before you ask, it's not for me. It's for... my cousin who got on the wrong side of the law. You see, he was holding up a convenience store and just when he ran away some costumed nutjob comes in and beat him up! No warning, no 'stop-or-I'll-shoot', no nothing! The hero just beats him up, ties him upside down to a lamppost, and hangs a sign that says, "I'm a criminal, arrest me.". And you know what? The police do exactly that!

Now that bothers me. Why? Because for one, my... cousin just got mugged by a guy in a costume! He was ten blocks away from the store he robbed, so the hero couldn't have seen the crime, and if he did so what? The hero didn't read him any miranda rights, beat him up on suspicion alone, and then tied him up in a humiliating fashion while he was still hurting from the beating! Worse, the cops just assumed he was doing something wrong just because the hero put a sign around his neck, so they took him in! It was later that they found out that my... cousin robbed a convenience store.

Now, I'm not saying that my... cousin shouldn't do the time for the robbery, but come on! That hero caused my... cousin undue pain and suffering due to his ordeal. He has nightmares of the night, and his knee has been acting up ever since the hero injured it in the fight. What can we do about it? It's kinda hard to take legal action on a man that hides his identity and stalks from the shadows. What can be done for my... cousin?

I'd consider a claim for trademark and copyright infringement. Talk to Brock and find some t-shirts with the Venom symbol. This suit could entitle Brock to get damages, and even better get me some attorney's fee. Hoo ahh!
